Article III - Term

Contract is for 2016-2017, 2017-2018, and 2018-2019.  In the latter two years, either party may open up to two articles, not including Salary (Article XI, Appendices D1 and D2) and Health and Welfare (Article IX).

Article V –Assignment/Reassignment/Class Relocation/Transfer

Section 5.3.2:  Expressly allows RCOE to post vacancies outside and inside for “in-house only,” but inside applications must be considered prior to outside applications.

Article IX – Benefits

Section 9.1.1: Effective 1/1/2017, the Employer will contribute up to $3,000 annually for 123-day, seasonal/8-hours per day Migrant Head Start unit members who enroll in the Employer’s REEP medical insurance program.

Made some technical changes to other sections regarding PEMHCA, the CalPERS health benefits program.

Article XIII – Program Service Quality Review (PSQR)

Changes clarified membership selection, criteria, and numbers in the PSQR committees.  Requires at least two meetings per year or as agreed upon by the committee.  Health and safety will be a standing agenda item.

Article XI – Salary

Continue the salary (20% increment) and hiring and retention incentive ($2,500) for Speech and Language Pathologists.

Effective January 1, 2017: increase the salary schedules by 10%.

Effective July 1, 2017:

Provide a 3% of base salary increment for Alternative Education and Special Education unit members assigned to a base site in Palm Springs USD, Desert Sands USD, and Coachella Valley USD.

Provide a 7% of base salary increment for Alternative Education and Special Education unit members assigned to a base site in Desert Center USD or Palo Verde USD.

Provide a 5% of base salary increment to DHH, VH/VI classroom and itinerant teachers, and Audiologists.  Provide a $2,000 signing and retention bonus to those unit members, one half upon employment and one half after one complete year of service with RCOE.

Compress the D1 and D2 Salary Schedules by deleting the 2016-2017 Row 1 and renumbering accordingly.  Unit members eligible for step advancement will move up to the numbered row that they would be on if compression had not occurred.  For example, a teacher on Row 1 this year will move up to Row 2 next year.  Row 2 will be the equivalent of this year’s Row 3.

Longevity steps (14 to 29.5 after compression) will be on the salary schedules, and movement to those steps will be based on continuous advancement from initial placement, not limited to years of service with RCOE.

Effective January 1, 2019: Increase the D1 and D2 Salary Schedules by 5%.

Article XIV – Leave Provisions

Section 14.3.5: Deleted the exclusion of Workers’ Compensation injury or illness from Catastrophic Sick Leave program.

Section 14.4.1(d)(3): Added prohibition against use of Personal Business Leave for purposes of personal convenience or for the extension of a holiday or vacation, or for recreational activities, or for other employment.

Section 14.4.2(e): Provided that use of PN/PB for “Conditions beyond the control of the bargaining unit member” is subject to director approval.

Section 14.5.2: Added a bunch of relatives to the bereavement leave section, conforming the list of family members to those in the CSEA Agreement.

Section 14.5.3: Provides for certain verification information for use of bereavement leave.

Article XXI – Health and Safety

Section 21.1(B): The Employer will consult with the Association on potential remedies to conditions which are reported to be unsafe.

Appendix D1

Section III(B)(1): Effective July 1, 2017, increases the maximum starting step for CTE/ROP Instructors based on vocational experience to Step 7 in Column 1 and Step 8 in Columns 2-6.

Section IV(E): Provides that a unit member must “serve” at least 75% of the total contract year and “and receive” a better than “Unsatisfactory” evaluation.  Previous language said that the unit member had to be “in a paid status” rather than “serve,” meaning, for example, the employee could have missed more than 25% of the school year on sick leave or paid administrative leave (PAL) and still receive a step advancement.  If the unit member is placed on PAL and the allegations are found to be unsubstantiated, the time will count towards step advancement.

Section IV(G): Deleted the June 1998 sunset of this section.  The section pertains to requesting travel time to attend classes that would qualify for salary schedule movement, subject to division head approval.

Section V(B): Provides a process for removal of a Lead Teacher from the assignment during the school year.  Increases Lead Teacher stipend by 10%.

Section V(C): Increases from $550 to $600 the annual stipend for CTE/ROP Instructors serving as student organization advisors.  The Executive Director approves and identifies the qualifying student organizations.

Section V(D): Deleted this section, because Program Specialists are not positions in the unit.

Section VI(B): Provides a system for notification and scheduling vacation “tracks” for 220-day unit members.

Appendix D2

Section III(E): Conforms step advancement language to D1 provided above.

Section IV(A): Provides for removal from the Contact Teacher assignment.  Increases Contact Teacher stipends by 10% and rounds off to whole dollars.

Yesterday RCOTA bargaining team was in Riverside for another mediation session.   There was a point where we had hoped to actually have a contract  that we felt would be accepted by the members but that was not the case.  Our mediator will be certifying us to Fact Finding Monday.    I will keep you informed as we move forward with dates.  As always we  appreciate your support and welcome questions.  We are having a General Membership Meeting Friday  December 2nd at the Farms House  from 5-7:30 or 8:00pm . We hope to see you there.

Dear RCOTA Unit Members,

  Our negotiations team met with the RCSS team of Friday, June 10th.

 We had a few items to work out, including salary and benefits.   We reached an agreement on our STEP program. (Replaces PAR)  It puts in place a very simple process for teachers to ask for and receive assistance in a variety of areas.  If a teacher asks voluntarily for assistance no record would go in their file.  The assistance will come from a fellow educator who has applied to be a support.  Please read the STEP Language in our contract.  It is much better if you have an evaluation with needs to improve in any area to ask for help voluntarily, before you receive an unsatisfactory review that may trigger mandatory participation and includes records being added to your personnel file. 

 We made a final proposal for first row compression (1.41 net increase and asked for 7.6% on schedule for a total of 9% salary increase overall for the 2016-17 year and another first row compression and 8.5% on schedule for the 2017-18 year.  The RCSS continued to offer the same amount as first stated, and based on our survey, the membership indicated that was not acceptable.   Did I raise the expectations for members by communicating in the survey?  I hope so!  Unfortunately this means that our MOU’s will be ending and not renewed until we have an agreement.   I have posted the survey on our website for your perusal.  

Because we were not close to an agreement on salary we declared a mutual impasse.    Meetings will be scheduled through the summer with a mediator in an attempt to resolve the impasse.   We will continue to inform our members through county email, and as always feel free to contact your Union leadership if you have questions or concerns.  Our website will have updates as well.  www.RCOTA.us .

Retiree’s announced … Sheryl Bell our Membership Chair and dedicated State Council Rep is retiring.  Volunteers for the position of Membership chair we encouraged for consideration.

In fact, volunteers for committees are always welcome, as we move through impasse and perhaps Fact Finding, we will need people on organizing to assist in making our voices heard.

 Every person can write letters to their area trustee board members and invite them to your classroom and educate them as to the dedication and excellence we offer as Professional educators for RCOE, and ask only for respect and comparable pay.  The BOE does not have to power to grant our raises, but they do approve the budget and can question it if they are receiving continuous communications from their constituents. 

The meeting ended with numerous members being awarded gifts from our vendors at the drawing.   We appreciate all the members who have communicated with the Leadership and encourage continued dialogue.   Remember…. Union begins with U!
